Default Sub Totals option greyed out

I have imported data from an ODBC data source using querry in Excel 2007.

If I select a cell within the returned data the sub total option on the data
tab is greyed out and I cannot sub total the data.

If I select a blank cell outside of the returned data range the subtotal
option is available.

I have always been able to import the querry data and immediately apply sub
totals in Excel 2003
