Default Color "on top" determined how?

Yes - the highest Plot order is on top. Right-click any series, selected
object, Series order. Changing order will also change the order shown in the
Legend.

Another approach you might consider, you can make the 'inside' or background
of markers transparent (no color). With judicious choice for the outline or
foreground of colour, size, marker style it may be possible to have several
points directly on top of one another and still be able to identify each
marker.
